You probably often here about how this country has become a “litigious society”.  Such statements are usually made by politicians or the media.   We are led to believe that almost every time a dispute arises between two people, it results in a Court battle.  In large part, this belief is based on peoples’ misunderstanding of the legal process as a whole.

In reality, the vast majority of legal disputes never end up in Court or result in a trial on the issues.  One possible explanation, although somewhat difficult to believe, is the public’s willingness to seek legal counsel when a dispute arises.  In many cases the early involvement of a Texas lawyer will lead to a compromise between the parties before the dispute goes to Court.  By utilizing attorneys, each party in the dispute obtains a greater understanding of the law and is able to determine what the probable outcome in Court would be.  Once the parties are presented with this information, the matter is often settled and the wronged party is compensated without the need for litigation. Court to order another party to provide you with what is owed to you under the law, or to find you not responsible for another party’s damages, is a serious task.

To be successful, you must have an experienced civil law attorney that understands both the facts of the case and the law, and who can effectively communicate both to the Court.  After each side presents their case to the Court, a judge or jury will review the underlying facts of the dispute, weigh the evidence and arguments of each side, and make a determination as to what will be the outcome of the case.
