Unforeseen medical conditions, or even difficulty due to aging, can often cause problems in managing and caring for a loved one.
 
While establishing a guardianship is never a desirable option, it is sometimes necessary and may be an alternative that warrants serious consideration.
 
A guardian is someone appointed by a court, to protect and ensure the well-being of an individual (the Ward) who has become partially or totally incapacitated.  Guardianships in Texas can be either of the person, the estate, or both.  A guardianship of the person consists of rights and duties related to the physical aspects of the ward, including the right to determine the place of residence, the duty to provide food, shelter and to consent to medical treatment.  A guardianship of the estate relates to the property rights of the ward and charges the guardian to prudently manage the wards property and financial interests.
